Cardlivo Terms of Service

These terms govern your use of Cardlivo, our Pokémon card cataloging and pricing service. By using Cardlivo, you agree to these terms. If you do not agree, you must not use the service.

Acceptance of Terms

By creating an account or otherwise using Cardlivo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated into these terms.

You must be at least 18 years old to use Cardlivo. Because Cardlivo is a paid subscription service, this is the age at which you're able to legally enter into that agreement yourself, not just a content-appropriateness cutoff. By using the service, you represent that you meet this requirement.

Service Description

Cardlivo identifies Pokémon cards from photos by matching them against a reference index, pulls market pricing from eBay and TCGplayer, and generates listing-ready CSV exports. Service availability may be subject to maintenance or technical issues.

Cardlivo displays market pricing data sourced from eBay and TCGplayer. Connecting your own eBay account is optional: without it, the eBay CSV export remains a file you download and upload to eBay's own bulk listing tool yourself. If you do connect your account, Cardlivo can create and publish real, live listings on eBay directly on your behalf, using the settings you configure - but only for the specific cards you review and approve through Upload to eBay Store, never automatically or without that review step. We are not responsible for the availability, accuracy, or terms of these third-party services, and your use of them (including actually listing or selling anything on eBay) is at your own risk and subject to their own terms.

User Accounts

You must provide accurate and complete information when creating an account, and email verification is required before you can log in. One account per person. You are responsible for maintaining your account's security and for all activity under it - notify us immediately at the email below if you suspect unauthorized access.

User Responsibilities

You agree to:

• Keep your account credentials confidential and use a strong, unique password.
• Only upload card photos you have the right to upload and use the service for legitimate purposes.
• Comply with applicable laws and respect intellectual property rights.
• Review our Privacy Policy so you understand how your data and photos are handled.
• Use exported data (including any eBay listings you create from it) responsibly.
• If you connect your eBay account, review each card's title, price, and condition in the review screen before clicking Publish - Upload to eBay Store creates real, live listings immediately, not drafts, and you are responsible for their accuracy and content.

Prohibited Activities

The following are strictly prohibited and may result in account suspension or termination:

• Uploading counterfeit card images, malicious files, or content you don't have the right to upload.
• Uploading images with no legitimate connection to card identification (e.g. non-card images, random or test uploads, or content intended solely to consume resources).
• Submitting deliberately false corrections intended to corrupt the shared reference index.
• Attempting to reverse engineer Cardlivo's matching systems or circumvent payment systems.
• Using automated tools to abuse the service, sharing account credentials, or reselling access to your account.
• Abusing our APIs or backend systems - excessive requests, scraping, or circumventing rate limits or access controls.
• Using the service for illegal activities or interfering with its infrastructure.

We reserve the right to investigate and take appropriate action - including suspension, termination, and potential legal action - for any suspected violation.

Payment Terms

Cardlivo offers three plans, all with the same features: Monthly and Yearly, which auto-renew until canceled, and Lifetime, a single one-time payment. There is no credit or usage-limit system - every plan includes unlimited scanning and matching.

Payments are processed by Stripe. We do not store your full card or bank account details on our servers - Stripe's own terms of service and privacy policy apply to your payment data. By subscribing, you authorize us to charge your chosen payment method for the plan you select, on a recurring basis for Monthly/Yearly plans. A failed renewal payment may result in your account losing access until it's resolved.

You can cancel a Monthly or Yearly subscription at any time directly through Stripe's self-service billing portal (a "Manage billing" link in your account's Billing section), or by emailing us at the address below and we'll process it for you. Cancellation takes effect at the end of your current billing period - you keep access until then, and there's no partial-period refund.

Refund Policy

Except as required by law, all fees are non-refundable.

At our sole discretion, we may consider refund requests submitted to the email below. Approval of any refund is not guaranteed and doesn't create an obligation to provide refunds in the future.

If you are a consumer in the United Kingdom or European Union, you have statutory rights to cancel certain digital-service purchases within 14 days under applicable consumer law. Nothing in this section limits those rights. By starting to use the service immediately after purchase, you acknowledge that you may lose the right to cancel for digital content already supplied.

Affiliate Disclosure

Some links on our website, in our product, or in our communications may be affiliate links. This means we may earn a commission if you click a link and make a purchase, at no additional cost to you. This does not affect the price you pay or influence our recommendations.

Intellectual Property

All service content, features, and functionality - including our matching systems and branding - are owned by us. You may not copy, modify, or distribute our intellectual property. You retain ownership of your card photos and exported data.

Cardlivo does not store the card photos you scan - matching happens in memory and the result is sent back to your browser, which saves accepted images to a folder on your own computer. The license below applies only to the images we actually do store:

• Correction photos - if you flag a match as wrong and submit a corrected identification, you grant us a license to store that photo and, if a moderator approves it, add it to the shared reference index used to identify cards for every Cardlivo user going forward.
• Your own listing photos - if you upload your own photos for use in an eBay CSV export or a listing published via Upload to eBay Store, you grant us a license to store and use that photo solely to generate that export or listing. We do not use it for any other purpose, and we automatically delete it 2 hours after upload - eBay copies the image to its own servers once it processes your CSV or publishes the listing, so it keeps working after our copy is gone.

We do not use your photos to train third-party AI models, and we do not use them in marketing or promotional materials without asking you first. You may opt out of contributing future corrections to the shared reference index simply by not submitting them.

Limitation of Liability

The service is provided "as is." We strive for accuracy but cannot guarantee 100% accuracy in card identification or pricing - results are estimates and should be verified, and market pricing is for reference only. We are not responsible for decisions made based on our output, or for downtime, data loss, or service interruptions. We may suspend or discontinue the service at any time. If you use Upload to eBay Store, you - not Cardlivo - are responsible for reviewing and approving each listing before it publishes; we are not liable for errors in a published listing's content, pricing, or for eBay account-level issues (such as Business Policies eligibility) outside our control.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid for the service in the 12 months preceding the claim.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold us harmless from claims, damages, losses, and reasonable legal fees arising from: (a) your breach of these terms, (b) your violation of applicable law, or (c) infringement of third-party rights by content you upload. This does not apply where a claim results from our own negligence or wilful misconduct, and does not limit any non-waivable consumer rights you may have under the law of your jurisdiction.

Data & Privacy

Our data practices are governed by our Privacy Policy. Depending on where you live, you may have rights to access, correct, delete, port, or object to the processing of your personal data. To exercise these rights, email us at the address below - we aim to respond within 30 days (UK/EU GDPR) or 45 days (California CCPA/CPRA).

Termination

You may cancel a recurring subscription at any time (see "Payment Terms" above); cancellation takes effect at the end of your current billing period. Account deletion requires emailing us at the address below. We may suspend or terminate accounts for violating these terms or for non-payment, or discontinue the service with notice. Termination does not affect obligations that already accrued.

Changes to These Terms

We may update these terms from time to time. For material changes, we'll give at least 30 days' notice by email before they take effect. You may close your account before the effective date if you disagree with the changes; continued use after that date means you accept them. The "Last updated" date above reflects the most recent version.

Governing Law & Disputes

These terms are governed by the laws of the jurisdiction in which we operate. We encourage informal resolution first - contact us at the email below with any issue before pursuing other options.

General

These terms, together with our Privacy Policy, are the entire agreement between you and us regarding Cardlivo and supersede any prior agreements or understandings.

If any provision of these terms is held invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

Trademarks & Third-Party Services

Cardlivo is an independent, fan-made tool and is not affiliated with, endorsed, sponsored, or specifically approved by Nintendo, The Pokémon Company, Creatures Inc., eBay Inc., Stripe, Inc., or TCGplayer Inc. Pokémon and all related names, characters, images, and trademarks are the property of their respective owners, and are referenced only to describe and identify the cards our service catalogs.

eBay, Stripe, and TCGplayer are used solely to provide pricing, listing-export, and payment functionality as described elsewhere in these terms, and remain the trademarks of their respective owners. Your use of those third-party services through or alongside Cardlivo is subject to their own terms and policies, not ours.
